The IHG® Rewards Club program ("Program") membership and its benefits are offered at the sole discretion of Six Continents Hotels, Inc. (“SCH”) and its subsidiaries and affiliates that are companies in the InterContinental Hotels Group (collectively “IHG”). Hotel brands currently participating in the Program include InterContinental®, Crowne Plaza®, Hotel Indigo®, Holiday Inn®, Holiday Inn Express®, Express by Holiday Inn™, Holiday Inn Select®, Holiday Inn SunSpree® Resorts, Holiday Inn Resort, Holiday Inn Garden Court®, Holiday Inn Club Vacations™, Staybridge Suites®, and Candlewood Suites® (collectively, “IHG Hotels”). Brands may be added or deleted at the sole discretion of SCH. The Hotels Anywhere benefit is solely for IHG® Rewards Club members who log in to the Hotels Anywhere web site. 

SCH has engaged Switchfly, Inc. ("Switchfly"), a third party provider, to host the Hotels Anywhere website – a private label hotel reward redemption web site (the "Site"). Switchfly has engaged Connexions Loyalty Travel Solutions, LLC ("Connexions" or “CLTS”) to act solely in the capacity of agent for suppliers of hotel stays to provide members of the IHG®Rewards Club program ("Members" or "you") with the ability to redeem IHG® Rewards Club points, or a combination of points and currency, for hotel stays through the Site. SCH, Switchfly, and Connexions, together with their subsidiaries and affiliates, and their respective officers, directors, employees, representatives, agents, representatives and licensors, shall be referred to collectively herein as the "Covered Parties". All suppliers providing hotel stays are independent contractors and are not employees of the Covered Parties.

These terms and conditions (the "Hotels Anywhere Terms and Conditions") govern your redemption of IHG® Rewards Club points (or points and currency) for hotel stays through this Site and describe your responsibilities regarding such redemption. By redeeming for hotel stays on the Site you agree and warrant that: 

You are at least 18 years of age, or at least the age required for an age of majority in your local or national jurisdiction (whichever is greater), and possess the legal authority to enter into this Agreement;

You have read, understood and accepted these Hotels Anywhere Terms and Conditions;

All information supplied by you or members of your household using this Site is true and accurate; 

You have read, understood and accepted the IHG® Rewards Club Global Membership Terms And Conditions which are incorporated by reference herein (the "Program Terms");

You have read, understood and accepted the IHG® Rewards Club Website Terms of Use which are incorporated by reference herein (the "Website Terms of Use"); and

You consent to SCH and its authorized third party agents processing data that is personal to you, and disclosing such data to third parties (such as hotel properties), necessary to fulfill your redemption order, and transferring data across national borders, including transfer to companies in the United States, in accordance with the Hotels Anywhere Privacy Statement;

If you do not agree with any of the foregoing, do not redeem for hotel stays in the Hotels Anywhere program. These Hotels Anywhere Terms and Conditions shall control to the extent of any conflict with the Program Terms and the Website Terms of Use, and may be amended at any time by SCH posting amended terms and conditions on the Site. Any such amended Hotels Anywhere Terms and Conditions shall become effective upon posting. By booking a hotel stay, you agree to be bound by the Hotels Anywhere Terms and Conditions as amended from time to time and you also agree to review such Terms and Conditions prior to travel. 

USE OF SITE. In addition to the general provisions for website use set forth in the Website Terms of Use, you agree that:

You are responsible for any error in the accuracy of information provided in connection with this Site; and

You will inform any other individuals for whom you book hotel stays of these Hotels Anywhere Terms and Conditions;

You are responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this Site.

REDEEMING FOR HOTEL STAYS. In addition to the provisions governing redemption of IHG® Rewards Club points set forth in the Program Terms, you agree that:

Hotel stay reservations are available through preferred suppliers of Connexions and may not be available for all locations and destinations.

Hotel rates and information displayed on the Site, or in related marketing materials for the Hotels Anywhere program, are valid for specific circumstances and for a limited time; they are subject to change without notice and may be withdrawn at any time. The hotel rates are only guaranteed at the time of redemption/booking.

IHG® Rewards Club points (or a combination of points and currency) can only be redeemed for the original hotel stay booking and associated fees and taxes. Room Rates presented on the site include all applicable taxes; however a limited number of hotels may charge Resort Fees or other hotel-specific surcharges that are not included in the price displayed on the Site. Such fees will be payable directly to the hotel.

These hotel bookings are pre-paid (advanced purchase) bookings. Cancellation fees or penalties may apply. See “Itinerary Changes or Cancellations” later in these Terms and Conditions for additional details.

The hotel property, or the intermediary providing booking services and issuing payment to the actual hotel property for your booking, shall be responsible for reporting, collecting and remitting any and all applicable taxes due in connection with the provision of the hotel stay, including sales tax. Notwithstanding the above, any charges for incidentals, or other fees that you incur while traveling are not included in your original hotel stay booking (unless specifically referenced in your reservation confirmation) and must be paid by you directly to the hotel property. These charges may include but are not limited to parking fees, room service or restaurant charges, mini-bar charges, telephone fees, internet usage fees, in-room movies, use of fitness center or spa facilities, babysitting, and gratuities. These additional fees and charges cannot be paid for by redeeming IHG® Rewards Club points and must be paid in currency, via a major credit card or similar form of payment, as required by the hotel property. Where required by applicable law, Sales Tax will be collected on these supplemental payments.

Special requests made to hotel properties (including your preferred size, type or number of beds) are on a request-only basis unless specifically offered on the Site, and cannot be guaranteed. Fees and charges may apply, depending on the nature of the request. Due to hotel property policies applicable to our preferred rates, your name may not be provided to the hotel property until 24 hours prior to your scheduled arrival. Before such time, please call the applicable customer service number listed on your Hotels Anywhere email confirmation for assistance with any special requests.

Every reasonable attempt will be made to notify guests of major renovations or refurbishments at hotel properties; however, the Covered Parties shall not be liable for non-disclosure by the hotel property.

The hotel property may require a major credit card, in one of the guests’ names, or a cash deposit upon check-in. Valid identification is also required at check-in.

Due to hotel property policies applicable to our preferred rates, most hotels stays booked through the Site will not be eligible for points or other credits in the relevant loyalty, recognition, or rewards programs; the rewarding of any points or credits is at the sole discretion of the hotel property.

Your use and/or abuse of the redemption program offered by this Site in contravention of the Hotels Anywhere Terms and Conditions may result in you being denied access to the Site and in the termination of your IHG® Rewards Club membership.

If you choose to purchase a hotel stay with a combination of points and currency, Connexions will be the merchant of record and will collect and process your payment(s). Transactions will be processed under the name “Trip Charges”;.

Only certain brands of cards may be used for the currency portion of the purchase, if applicable. Those choices currently include Visa, MasterCard, American Express, and Discover credit cards and Visa or MasterCard debit cards;

All hotel inventory will initially be priced in US Dollars (USD). 

ITINERARY CHANGES OR CANCELLATIONS. At the time of IHG® Rewards Club point redemption, all hotel stay purchases are deemed final. Change and cancellation policies will vary by hotel property, and by the specific preferred rate that is booked. If you need to make changes to your travel itinerary, please call the applicable customer service number listed on your Hotels Anywhere email confirmation. 

In most cases, if you are requesting a cancellation sufficiently far in advance of your scheduled arrival and check-in (72 hours in advance, for most, but not all properties), you will be able to obtain at least a partial refund of your IHG® Rewards Club points (or the combination of points and currency) that were used for your initial hotel stay purchase. However, a limited number of hotel stay purchases available on the Site cannot be canceled, and you will not be eligible for any refund of your IHG® Rewards Club points and currency (if applicable). All cancellations will, at a minimum, be subject to a $35 service fee (per booking) charged by, and paid directly to, Connexions. Bookings will not be refundable after the date of scheduled arrival and check-in has passed. A “no show” for a hotel stay booking will, in most cases, result in a total forfeiture of settlement, without credit due. 

Changes to your hotel stay purchase may typically be made prior to check-in, subject to availability and the policies of the hotel property. Changes to the name of the traveler will not be accepted within 48 hours of scheduled check-in. In some instances, changes will not be available or permitted. All changes may be subject to a $35 service fee (per booking) charged by, and paid directly to, Connexions. Changes may also be subject to additional fees and/or additional charges for each room night as advised in the policy information of the hotel property. 

No such additional fees or charges associated with a cancellation or change may be paid for with IHG® Rewards Club points. Payments to either Connexions or the hotel property must be made via a major credit card or similar form of payment. All fees charged directly by Connexions will be quoted and charged in US Dollars only. Change fees are subject to change without notice. Connexions will be the merchant of record and will collect and process your payment(s). Transactions will be processed under the name “Trip Charges”. In the event of an involuntary change or cancellation due to weather, war, terrorism, epidemic outbreak, natural disaster, acts of civil unrest, or other acts of God, the associated fees may be waived at the discretion of Connexions and/or the hotel property.

INTERNATIONAL TRAVEL REQUIREMENTS. International travel generally requires the traveler to possess a valid passport. Visa policies vary by country and any necessary visas are the sole responsibility of the traveler and must be obtained prior to departure. Travelers are responsible for complying with all government travel requirements, and presenting exit, entry and other required documents such as passports and visas. 

REQUIREMENTS FOR CHILDREN. Policies for children vary by hotel property. Child benefits may be extended to you should a hotel property offer such benefits.

Children under the age of 18 traveling internationally without one or both of their natural parents must carry a notarized letter of permission from the absent parent or parents. These document requirements are the sole responsibility of the traveler. 

HAZARDS. SCH and the other Covered Parties have no special knowledge regarding health hazards, political climate, weather hazards, supplier financial information or safety records, or foreign entry requirements, and do not represent or warrant that travel to any destination is without risk. and http://www.cbp.gov, and www.international.gc.ca.

LIMITATION OF LIABILITY. IN NO EVENT SHALL SCH OR ANY OTHER COVERED PARTY BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH ANY USE OF THIS SITE, THESE HOTELS ANYWHERE TERMS, REDEMPTION OF IHG®REWARDS CLUB POINTS FOR HOTEL STAYS, THE USE OF THE HOTEL STAYS OR ANY ASSOCIATED TRAVEL, EVEN IF A COVERED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. No Covered Party shall be responsible for any hotel property’s failure to comply with these Hotels Anywhere Terms and Conditions nor for any hotel property’s failure to comply with applicable federal, state, provincial and local law. If, notwithstanding the above, a Covered Party is found liable for any loss or damage relating to the use of this Site, you agree the liability of any such party shall in no event exceed the amount of IHG® Rewards Club points (or the combination of IHG® Rewards Club points and currency) redeemed for the hotel stay in question. Some countries, states, territories, or provinces, to the extent their law might be deemed to apply notwithstanding the selection of laws of the United States and the State of Georgia as described below, do not allow for the limitation of liability, so the foregoing limitations might not apply to you. 

INDEMNIFICATION. You agree to indemnify and hold IHG and the other Covered Parties and their subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of your breach of these Hotels Anywhere Terms and Conditions or your violation of any law or the rights of a third party. A Covered Party's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches. 

SELLER OF TRAVEL. Connexions is a registered seller of travel in the United States. 

GOVERNING LAW. Any disputes arising out of or related to your use of this Site, these Hotels Anywhere Terms and Conditions, or the Hotels Anywhere program shall be handled individually without any class action, and shall be governed by, construed and enforced in accordance with the laws of the United States and the State of Georgia. To the extent any of the program rules are inconsistent with local law, local law will apply. 

ENTIRE AGREEMENT. These Terms and Conditions, together with those incorporated herein or referred to herein constitute the entire agreement between us relating to the subject matter hereof, and supersede any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this Site.
